These Terms and Conditions set out how you may use our website and, for trade customers, how we supply goods to you. By using this site or placing wholesale orders with us, you agree to these terms.
A. Terms for Consumers / Website Users
1. Catalogue only – no direct sales
Dreamland Bedding is a wholesale supplier. This website is a catalogue and information resource only. We do not sell directly to the public from this site or from our warehouse. All purchases are made through independent retailers (stockists), who have their own terms of sale.
2. Product information
We work hard to keep product information accurate and up to date, but details such as specifications, fabrics, finishes and availability may change without notice. Colours can vary between screens and real life. Always check key details with a retailer before purchasing if something is critical for you.
3. No purchase contract on this site
Because we don’t sell direct, viewing information on this website does not create a contract of sale between you and Dreamland. Any contract of sale is between you and the retailer you buy from. Pricing, payment, delivery and returns are governed by the retailer’s terms.
4. Consumer rights and warranties
Our products come with warranties against manufacturing faults and defects, and New Zealand consumers also have non‑excludable rights under the Consumer Guarantees Act 1993. Nothing in these terms is intended to limit those rights. Warranty claims for household customers are made via the retailer you purchased from; they will liaise with us on your behalf.
5. Website use and liability
We provide this website “as is” for general information. We do not guarantee uninterrupted access or that the site will be error free. To the fullest extent permitted by law, we are not liable for any loss or damage arising from your use of, or reliance on, information on this site. If you are dissatisfied with the site, your remedy is to stop using it.
6. Intellectual property and fair use
All text, logos, graphics and images on this site are owned or licensed by Dreamland. You may view and print information for personal use only. You must not copy, reproduce or use our content for commercial purposes without our prior written permission. If you’re a retailer, we’re happy to provide authorised images and assets.
7. External links
Any links to third party websites (for example, retailer sites) are provided for convenience only. We have no control over, and take no responsibility for, the content or practices of those sites.
8. Privacy
Any personal information collected via this site (for example, via contact or stockist forms) is handled in accordance with our Privacy Policy.
9. Governing law
This website is operated in New Zealand. These consumer/website terms are governed by New Zealand law, and you submit to the non‑exclusive jurisdiction of New Zealand courts.
B. Terms of Trade for Stockists / Business Customers
1. Trade accounts
Businesses must apply and be approved as a stockist or trade customer before ordering at wholesale pricing. We may approve, decline or cancel accounts at our discretion.
2. Pricing and payment
Wholesale prices are quoted exclusive of GST unless stated otherwise. Prices are subject to change. Payment terms (for example, prepaid or approved credit terms) will be advised when your account is opened. Invoices must be paid on or before the due date. We may charge interest on overdue balances and suspend supply on overdue accounts.
3. Orders and availability
Orders must be placed via our B2B portal. Order acceptance is subject to stock availability and our confirmation. We may refuse or amend orders where there are errors, misprints or supply issues. Once picked or dispatched, orders cannot be cancelled without our agreement.
4. Delivery and risk
We can arrange delivery via our freight partners or you may arrange your own collection. Freight charges, free freight thresholds and delivery timeframes will be agreed with you. Risk in the goods passes to you on delivery to your nominated address or carrier. Please inspect deliveries promptly and advise us of any transport damage or discrepancies within a reasonable time.
5. Retention of title
Ownership of goods remains with Dreamland until we receive full payment for those goods and any other amounts owing on your account. Until title passes, you hold the goods as bailee, must keep them identifiable as Dreamland stock, and must not grant any security interest over them. If you default on payment, we may enter your premises (or the premises of any third party where the goods are stored) to recover goods that remain unpaid, to the extent permitted by law.
6. Returns (trade)
We do not generally accept returns of non‑faulty goods. Returns of overstock or change of mind items require prior approval and may be subject to a restocking fee. Faulty or damaged goods will be handled under our warranty/claims process.
7. Warranty and claims (trade)
We warrant that goods supplied to you are free from manufacturing defects for the warranty period applicable to each product range. For any claim, you must notify us promptly, provide supporting information (including photos) and follow our claims procedure. Our liability is limited, at our option, to repair or replacement of the goods or a credit/refund of the invoiced amount for those goods.
8. Limitation of liability (trade)
To the extent permitted by law, Dreamland is not liable to stockists for indirect or consequential loss, including loss of profit, loss of revenue or loss of opportunity. Our total liability in connection with any order is limited to the price paid or payable for the goods in question.
9. Brand representation
As a stockist, you agree to represent the Dreamland brand and products accurately and in good faith. You must not misdescribe our products, alter them without consent, or use our trademarks in a misleading way. We reserve the right to review and, if necessary, terminate stockist relationships where brand representation is inconsistent with our standards.
10. Termination
Either party may terminate the trade relationship on notice, subject to all outstanding orders and payments being settled. We may suspend or terminate supply immediately if you are in serious breach of these terms (for example, persistent non‑payment or fraudulent activity).
11. Changes to terms
We may update these Terms and Conditions from time to time. Updated versions will be published on our website or notified to active stockists. Continued use of our site or continued ordering after notice of changes will be taken as acceptance of the updated terms.
